ChemReady Terms of Service

1. Who provides the service
ChemReady is provided by LMW Jacek Kubas, ul. Rodzynkowa 30, 92-709 Łódź, Poland, VAT PL7272587939 (the "Provider"). Contact: contact@chemready.eu.
The customer (the "Company") is a business using the service for business purposes. The service is not offered to consumers.
2. What ChemReady is
ChemReady is SaaS that supports the Company in obligations under the CLP Regulation — in particular preparing a UFI identifier and a PCN notification to poison centres through the ECHA system.
- generates a UFI from data supplied by the Company,
- prepares and stores the notification dossier,
- produces drafts of CLP labels and of derivative documents, based on data extracted from the safety data sheet supplied by the Company,
- keeps a versioned archive of changes.
3. What ChemReady does not do
- ChemReady does not author a safety data sheet from scratch and does not replace a competent person under REACH. It works from a sheet supplied by the Company or its supplier.
- ChemReady does not provide legal or regulatory advice.
- ChemReady does not guarantee that a supervisory authority, poison centre or ECHA will accept a notification. That decision rests solely with them.
- ChemReady does not assume the Company's liability as the party placing the mixture on the market.
4. Test mode versus a production ECHA submission
- Test mode (sandbox) — the notification goes to ECHA's test environment. It has no legal effect and does not discharge the notification duty;
- Production submission — the dossier is transmitted to the live ECHA system.
As of today, production submissions are disabled at platform level. The service runs against ECHA test mode. ChemReady therefore does not currently file notifications with legal effect — it prepares the dossier, UFI and documentation, and the transmission goes to the test environment.
Enabling production submissions requires all of: the Provider switching the mode on, the Company's own ECHA account connected, the connection verified, and data validation passed. The platform never sends production notifications automatically or in the background — each one requires a deliberate action by the Company.
The current mode is visible in the panel. On a test-mode account every result is marked as a test. We will inform the Company before production mode is made available.
5. Account and roles
1. Creating an account requires an e-mail address and password. Company details may be completed later — but are required to generate a UFI and to notify.
2. The first user is the owner and may invite further users as administrators or members.
3. The Company is responsible for password confidentiality and for the actions of users it grants access to.
4. The Provider may suspend an account for a material breach of these terms, after notice — unless delay would create a security or legal risk.
6. Plans and scope
ChemReady is billed by subscription. The billing unit is the number of active products in the account, not the number of notifications sent.

Current prices — with currency (PLN / EUR / CZK) — are shown on the billing page and in the pricing section of the website, and apply as stated at the time of purchase. These terms do not repeat amounts, to avoid contradiction.
Once the active-product limit is reached, adding another product requires a plan change. Existing products and documentation remain available.
The credit model has been retired. Earlier versions sold PCN credit packs. That path is no longer sold and sending a notification does not consume credits. Unused credits bought before the change are honoured — please contact contact@chemready.eu.
7. Payments, renewal and invoices
1. Payments are handled by Stripe Payments Europe, Ltd. The Provider does not store card data.
2. A subscription is sold for a 12-month term only, payable in full and upfront for that term. Monthly billing is not offered.
2a. The subscription renews automatically for a further 12 months until the Company turns renewal off.
3. A VAT invoice is issued for each payment and is available to the Company.
4. Starter is a one-off payment and does not auto-renew.
5. A trial is granted individually and is not part of standard sales; where granted, its scope and length follow the arrangement with the Company.
8. Cancellation and its effect
1. The Company may cancel at any time from the billing page.
2. Cancellation takes effect at the end of the paid period; until then the service is unchanged.
3. After the paid period ends, new notifications and new products are no longer available.
4. Notifications already sent to ECHA remain effective — cancelling a subscription does not withdraw them.
5. After the paid period ends the account switches to read-only mode. The Company keeps access to its products and dossiers and can still download documents that were already produced; it cannot create new notifications or add products. The Company's full data set can be exported at any time from account settings.
6. Fees for a started billing period are not refunded pro rata unless mandatory law provides otherwise.
9. Refunds and the right of withdrawal
The Provider grants a voluntary refund guarantee. This is not the exercise of a statutory entitlement and does not limit any rights the Company has under mandatory law.
1. Where the Company has a statutory right of withdrawal under mandatory law, a request to begin performance immediately does not automatically mean losing it.
2. Independently of statutory rights, ChemReady offers a voluntary 14-day full refund guarantee, provided use of the service has not begun.
3. Use is treated as having begun at the earlier of: the first UFI generated or the first complete document package issued. Uploading a safety data sheet, creating a product and working in the wizard are not the beginning of use.
4. A refund under this guarantee is all or nothing — the Provider does not make pro-rata refunds.
5. The ChemReady voluntary guarantee does not limit rights the Company has under mandatory law.
10. The Company's responsibility for data
1. The Company is responsible for the accuracy, completeness and currency of the data entered — in particular mixture composition, classification, contact details and packaging data.
2. The platform validates data technically (completeness, format, ECHA rules) but does not verify it against the physical product.
3. A notification based on incorrect data is the Company's responsibility.
11. Availability
The Provider works to keep the service continuously available but does not offer a guaranteed service level (SLA) on standard plans. The service depends on external systems including ECHA; their unavailability is not a failure of performance by the Provider.
12. Liability
1. The Provider is liable for damage caused intentionally or through gross negligence under general rules.
2. Otherwise the Provider's liability is limited to the fees paid by the Company in the 12 months preceding the event.
3. The Provider is not liable for decisions of supervisory authorities or for the consequences of placing a product on the market.
13. Data processing
Personal-data processing is described in the Privacy policy. Where the Company entrusts personal data to the Provider, the parties conclude a data processing agreement (DPA) — the template is published at chemready.eu/en/dpa/ and a signable version is available on request at contact@chemready.eu.
14. Complaints
Complaints go to contact@chemready.eu with the account name and a description. We reply within 14 days.
15. Changes
Material changes are announced 14 days in advance by e-mail to the account address. The Company may cancel before they take effect.
16. Governing law
Polish law applies. Disputes are heard by the court competent for the Provider's seat.
